What Exactly is a Tax Lien Certificate...


And why are they such sensible investment vehicles?

When a property owner is unwilling or unable to pay his taxes a first position lien is put on his property. This lien certificate is then issued and sold to an investor such as yourself in order for the county to recover it’s debt.

In effect you pay the taxing jurisdiction the tax arrears so it can continue to function and they guarantee you will get your money plus a handsome rate of interest back in the future.

What’s important here is the fact that it’s a first position lien - this means it precedes and cancels any other debts due on the property, even IRS ones... I’ll explain why this is so important in a moment.

As I said, the state levies either a fixed interest on the debt due or attaches a penalty charge. Interest rates and penalty charges vary from state to state but are typically in the order of 16% - 20%, with some as high as 25% or more... And the interest rate will not fluctuate as it is fixed at the time of lien issuance.

Now, when the property owner settles his debt, the county forwards the amount due plus interest directly to you as the lien holder...

this means you get all of your investment back plus interest.

 

What Happens if the Property Owner
Still Refuses to Pay?
